An interesting perspective Conrad, although I'm not totally convinced!

I'll hang fire for the moment, but I am fortunate in that I have a whizz-kid programmer who works for me and can find out where these sites are hosted. The rest I'll leave to your imagination.

Yes, I've had this happen, too. I've tried contacting the site several times, but they don't respond. There isn't much else I can do :(

I emailed the www.2shared.com website, and I did get a response - 2 actually. The first one said that they would take my pirated book down. The second one said to ignore the first one, and to follow the DCMA format.

The problem is that it looks like the standard DCMA format requires a response in writing or by fax. As the 2shared website includes neither, I can only email them, which I have done.

I am still not convinced that having your book pirated creates recognition. Recgnition for what? Just so that all your other books can get pirated as well? Too much graft and hard work went into them for that to happen.

BTW, the DCMA includes the requirement to:
Identify the in-world item that you claim is infringing on your copyright, and provide information reasonably sufficient to locate the item in-world.

Anyone know what is precisely meant by this sentence?

Yes, it's meant to confuse you ;-)

Title your email "Notification of Copyright Infringement"

Here's the notice:

The copyrighted work at issue is the ebook Title by Author, published by Author/Publisher, Publication Date, that appears on Link to book elsewhere

The URL where the copyrighted material is located is direct link to book on website you're contacting

You can reach me at email address/postal address/tel no for further information or clarification.

I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law.

I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner of an exclusive right that is allegedly infringed.

Yours
Name, Date, Time

Breaking that down...

The copyrighted work at issue is the ebook Title by Author, published by Author/Publisher, Publication Date, that appears on Link to book elsewhere

That line establishes what work it is you're contacting them about. Make sure you link to the first place it was published, especially if it was date stamped. Amazon is really handy for that (and yet another argument, coincidentally, against unpublishing and republishing a book).

The URL where the copyrighted material is located is direct link to book on website you're contacting

This is the content you're disputing, so make sure it's the correct link. If you've run a keyword search on a webpage to find your book make sure you're not linking to the search function, for example, but to the book itself. Remember each site will have a unique page for the book, although it may appear in search strings or genre lists, make sure it is a link directly to the individual book page.

You can reach me at email address/postal address/tel no for further information or clarification.

As a minimum provide your email address.

This is the specific legalese notice and your email is not binding without it.

Ooh, btw, that's the notice for if you own the copyright (as author). If you're contacting the site as publisher you need to say you're acting on behalf of the copyright owner, not that you are the copyright owner ;-)

Folks, it's worked! This is the response I got from the www.2shared.com website, via email:

Hello,

We have deactivated the link(s) to the illegal material. If you know
any other illegal use of our service, please let us know. We will do
the best we can to remove the files as soon as possible.

Best regards,
Lisa

Well, that's one small victory. We do need to keep vigilant....

Conrad, you make a very good point, and one that has inspired me to action. While I'm sure neither one of us is advocating piracy, it is wise to accept that it happens. Sure, file DMCA notices if you want, but take advantage of the situation, too. Include links in all your books to your webpage, blog, Twitter account, YouTube channel, Facebook fan page, and where people can buy all your books. Until your book is removed, at least you have turned it into a great marketing opportunity.

I haven't done a good job linking everything, but I will now go back and do exactly that.

My point exactly. My Free promos read like the best marketing tools. free samples of all my other works and info on where it can be found, I haven't mastered putting links in the books yet. I even found that with a good serialized story, even when I gave away my box sets, there was an uptick in purchases right after the free promo. Piracy is FREE FREE advertisement. You have to know how to harness it to make those people who like you enough to pirate you seek you out and purchase from you. I went from US$2 per month amazon royalties to US$550 per month using this method. I want to find a way to upload one or two of my parts to Kick Ass Torrents and the other popular ones. Anyone knows?

Yep, mine too. Thanks for finding this and posting. I'm in science fiction and there are a bunch of recognized authors on this site. I'm wondering how long my book's been up there. After several months of climbing sales, I've seen a noticeable drop in sales for my book over the last four or five weeks.

As for the posts about pirating being good, you're not going to convince me of that, sorry.

A little update...

I just got off the phone with the people at PayPal about the website RYUShare.com using PayPal to process fraudulent purchases on books that are copyright protected and they were a bit upset. They have immediately started a fraud investigation and will call me back for more information or updates as needed. They were a little apprehensive about the fact that the thefts crossed the copyright line and that it involved a giant like Amazon.

A little fishing shows that the RYUShare webdomain popped into existence March 1st, 2012 and the PDF4Share.net, March 30th 2012.

More later...
