Public Domain at 70%??

I deal entirely in public domain materials. For a long time, if I selected "public domain" on the first page of book creation under "2. Verify Your Publishing Rights", when I reached the second page, I had no choice but to select the 35% royalty option. The 70% was greyed out.

However, more recently, that 70% option has remained available. I haven't tested it yet, to see if its possible to get the 70% for a public domain item.

Did I miss a policy change somewhere along the line?
Has anyone else tried this and made the 70% instead of 35%?
