I'm not a lawyer, so I don't know. I'm just quoting the position of the Amazon Copyright/Trademark department, which is that there are rights associated with the use of series titles.

Again I would like to thank everyone for their kind words.
And Yes, my pen name is Lilian M.

I would like to say a thank you here though to Miss Abigail Reynolds for her post too!

It is true that I do not have a webpage, no twitter etc. My only page remains my Amazon Author Page and no, I do not have a Publisher. I am all on my own.
I had just started writing and was moving into self-publishing slowly, learning as I go.
Again, I appreciate Ms Reynolds trying to contact me and I will take your suggestion and try to contact Linda Berdoll.

It is very unfortunate that this has all happened and I have been very unhappy to say the least since this whole saga had begun, for almost a week now. The feeling of being accused and being subject to something like this really does take a serious toll on you.
I have stopped writing and am waiting to see how all this pans out.

Thank you everyone for your words and posts, I read them all and am heartened. YP.

Also, does everyone think I should be contacting the literary agency in question?<
Yes, and send them a copy of Abigail's post.

Authors on Amazon have wonderful exposure which is great. But authors on Amazon have incredible exposure, which is terrible.

Good luck and keep writing, it's a great way to fight the blues.

Hi Everyone,

There has been some new developments and I thought I would turn to the community again for this one.

I have heard back from Linda Berdoll and it appears that someone out there has created a blog using her name at the following URL: http://lindaberdoll.cheap-goo.com/
She suspects that I am the creator as so many of my titles are being advertised on it.

This is NOT my blog.

I have sent an email to the host: WordPress.com and have reported the abuse.
Are there any suggestions as to what other steps that can be taken in regards to this one?

Appreciated. YP

If it's not your blog, and is using her name, SHE is the one who needs to hunt down who created it and have it taken down, not you.

Thank you for answering!

Another development.
I have been in contact with Miss Reynolds and she has been very kind. She has indicated that she would have been happy with a series title change and she has since contacted her agent and they will be working with KDP to handle the issue.
So it looks like my review is in progress and hopefully it will be resolved soon.
Wish me luck everybody!

However, as to Miss Berdoll, I have just come from reading her blog and am very saddened by it.
Have a look: http://lindaberdoll.blogspot.com.au/
Its a post in which she calls me a "miscreant," and all sorts of nasty things!
I don't think she knows all the facts and this is just yet another blow to my fledgling writing career...

Man, I love a story that ends happily.

I'm writing a series of shorts under the Humble Nations banner if someone stole my series name I would rip out their flipping ... pen! But there again I don't think they'll be popular any way ... so not much to worry about. Lolz

Hi Everyone,

Got an email from KDP today telling me that they are NOT involved.
Turns out I needed to contact the agency directly from the first. Not that KDP had made that clear from the first. They just told me an investigation was pending. Now they are telling me that they do not get involved in third party issues and to contact KDP after the issue is resolved.

Anyway, I have written to the agent now and am waiting to hear from them.
Hopefully, this will all end well and soon.

Wait...didn't Amazon block the books in question? After the agency contacted them?

If that's not 'getting involved in third party disputes', what is? 0_o

Wow, she's kind of a bi...queen bee, isn't she?

Just type out 5000 words, upload it to Amazon, and you're good to go?

Really? Dang, wish I'd known self-publishing was THAT simple and easy. All this time, I've been trying to write good stories, format them properly, create good covers...paying editors!

Holy cows on crack. I've been doing it all wrong. ;)

I was not going to become involved in this, but I am a Jane Austen Indie author, too, and Abigail is a friend of mine. She does have an agent, but she is an Indie author, as is Linda Berdoll, right now, though both have been published in the past with Sourcebooks. It's looking like you will have to get a release from Abigail as she is the one who brought the complaint against you and the books in question.

Lilian, if it helps any, I believe you. I do not believe you opened the website under Linda's name, and, because you are not active in the JAFF world, I do not believe you acted maliciously with the book covers or the series title. I believe you didn't know Abigail had already selected Pemberley Variations as her title, and therefore, thought it was OK. I think these are innocent mistakes, and you have tried your best to rectify them. Contact Ms. Reynolds.

I hope you are able to resolve this soon.

Thank you everyone for your kind words.

I have been in contact with Miss Reynolds and she has been very kind.
She has been very understanding and has indicated that she would have been happy with a title change. Since, she has written me to say that she has contacted her agent and her agent was going to get in touch with KDP and handle the issue.

But the email I got from KDP today was what spooked me, if KDP is not involved then I thought I better contact her agent too!
I have given the agency an account of the issue as well as siting the correspondence that Miss Reynolds and I have exchanged. Hopefully, it will all be resolved soon.

This has been havoc for me. I have been very hurt by everything but it does look like now that a happy ending might finally be in sight!

I want to say thank you to all your posts, they have helped me heaps and I am very heartened by everyone's kindness!
Thank you!

Contact Abigail again and send her a copy of that reply. Then ask her when you might expect your books to be released. All it takes is one phone call to amazon and it is done.
